What Is an Appeal?

One of the legal vehicles available for seeking a different judgment in your criminal case is an appeal. When you pursue this avenue, you're asking an appellate court to review the trial court's decision.

An appeal is not a new trial. Instead, it involves three appellate judges examining the original court record and written brief you submit. They must determine whether or not a legal error occurred that impacted the outcome of your case. You cannot produce new evidence, and your arguments for appealing your conviction must be clearly stated in the written brief. Because of this, it's crucial to have our lawyers on your side who know how to craft these documents. We review every detail of your original trial and relevant case law to develop a convincing case on your behalf. In the event the appellate judges request to hear oral arguments, we have the skills needed to persuasively argue for a reconsideration of your judgment.

The possible outcomes of an appeal include:

  • Affirming the lower court's decision, meaning the original conviction and sentence will stand
  • Reversing the decision, which means the appellate court sides with the defendant (now referred to as an appellant) and may send the case back for a new trial
  • Modifying the judgment, if the appellate court deems a legal error occurred, it may correct the sentence

What Other Types of Post Conviction Relief Are Available?

Aside from pursuing an appeal, you may also file motions for other types of relief, such as withdrawing a guilty plea, reversing a conviction, or modifying a sentence. To seek post conviction relief, you must submit a notice of intent within 20 days of your judgment.

Upon receiving your notice, the court will notify the district attorney of your intent and hold a hearing.

Grounds for motions of post conviction relief include:

  • The court did not have the authority to issue the judgment or sentence (such action was out of its jurisdiction)
  • The sentence was greater than the lawfully allowable penalty
  • The defendant's constitutional rights were violated
